Terms and Conditions
- All orders are subject to accordance and approval by G & S Penrith Limited hereafter referred to as ‘the company’
- All orders shall be executed on the understanding that the placing of an order constitutes acceptance of these terms to the exclusion of all conditions of the Purchaser’s order except in so far as the same are expressly accepted by the company
- Prices are ex-works and exclude VAT, postage and packing (unless otherwise agreed in writing by the Company)
- Prices and designs are subject to change without notice, and all goods will be invoiced in accordance with prices ruling on date of order
- Shipment of Orders – All orders will be shipped as prompt and efficiently as possible. Delivery dates are approximate only and no liability can be accepted for any loss injury damage or expenses consequent upon delay in delivery from whatever cause
- Responsibility for goods in transit – the customer assumes responsibility for the goods from despatch. Transportation arrangements on selected carriers are made for and on behalf of the customer. Insurance for goods in transit is the responsibility of the purchaser. The company shall be responsible for the proper packaging and security of the goods but shall not be liable for damage caused thereto by third parties (including carriers). Except as otherwise accepted in writing by the company goods sold shall be at the sole risk of the purchaser as soon as they leave the company’s premises
- Failure to advise the company of non delivery of goods within 3 days from date of delivery specified in the order will relieve the company of allresponsibility and liability for loss
- Return of goods will only be accepted subject to prior written agreement by the company. Any goods accepted for return must be unused and in re-saleable condition.
- All goods accepted for return will be subject to a minimum of 15% handling and re-stocking charge (upon discretion of the company). It shall be the purchaser’s responsibility to return goods to the company at the purchaser’s expense.
- If within a period of delivery named in the order, the purchaser gives notice in writing to the company of any defect in the goods which shall arise under proper use from faulty materials or workmanship then the company shall with all possible speed replace or repair the goods so as to remedy the defect provided that:
i.The Purchaser shall have installed and all times used such goods properly and in accordance with operating instructions that might have been given by the company: and
ii.All such defects are reported on discovery by the purchaser and within 3 days from being supplied to the purchaser - The seller liability (if any) in respect of mis-description, loss or non delivery of, damage to, or defects in the goods shall be limited to repair, replacement, or refund of price and shall not exceed any claim for any consequential loss or damage of any kind whatsoever
- Payment is strictly nett 30 days from date of invoice, unless otherwise agreed in writing by the company. Shipment of goods may be delayed if any invoice remains unpaid after thirty days from due date
- The title to and the property in the goods will pass only on payment, and not on delivery only, of all amounts due under the order
- These terms and conditions shall in all respects be in accordance with English Law and the English courts shall have sole jurisdiction in all matters arising
